외교부는 국제해양법을 통해 해양환경을 보호하고 주변국과의 협력을 강화해나가기 위한 길을 모색하고자 12.3.(목)-4.(금) 양일간 ‘UN해양법 협약상 지역협력 및 해양환경보호’이라는 주제로 ‘제5회 해양법 국제학술회의’를 대면‧비대면 혼합 형식으로 개최하였다.
외교부가 2016년부터 매년 개최해온 해양법 국제학술회의는 국제해양법 재판소[ITLOS]*와 대한국제법학회가 공동 주관하는 국내 최대 규모의 해양법 관련 국제학술행사로, 해양법 현안에 대한 학계와 실무 간의 교류를 지원하고 해양법에 대한 국민들의 관심과 이해를 제고하는데 의의를 두고 있다.
지난 3∼4일 '유엔 해양법협약 상 지역협력 및 해양환경 보호'를 주제로 제5회 해양법 국제학술회의를 열고 해양환경보호와 지역협력 방안을 논의했다.
이틀간 대면·비대면 혼합 방식으로 진행된 이번 학술회의에는 함상욱 외교부 다자외교조정관과 백진현 국제해양법재판소(ITLOS) 재판관, 토마스 하이다 ITLOS 부소장, 박덕영 대한국제법학회장을 포함해 국내외 석학 등 200여명이 참석했다. 함 조정관은 축사에서 "인간이 그어놓은 해양의 경계는 자연 앞에서는 무의미한 만큼 해양환경 보호를 위해 국가들 간 협력은 필수적"이라고 밝혔다. 이어 "점차 심각해지고 있는 해양오염으로부터 우리의 일상을 지키기 위해 국제해양법으로부터 지혜를 구해야 할 때"라고 강조했다.
참석자들은 회의에서 해양환경 보호를 위한 국가 간 협력 제도화 사례, 분쟁 수역 내 해양과학조사 협력 방안, 해양오염 예방·규율을 위한 국가들의 노력, 해양환경 분쟁의 평화적 해결 방안 등을 논의했다.
또 유엔 해양법 협약이 해양환경보호 등 다양한 분야에서 부과하고 있는 협력 의무의 구체적 내용을 ITLOS 판례 등을 통해 검토했다. 다만, 조만간 해양 방출이 결정될 것으로 예상되는 일본 후쿠시마 오염수 문제에 대한 구체적 논의는 없었다고 외교부 관계자는 전했다. 외교부는 2016년부터 해양법 국제학술회의를 매년 개최해 왔다.
구체적으로는 △UN해양법협약 상 국가들의 협력 의무, △해양환경보호를 위해 국가 간 협력을 제도화한 모범 사례, △분쟁수역 내 해양과학조사 협력 방안, △해양오염 예방 및 규율을 위한 국가들의 노력, △해양환경 분쟁의 평화적 해결 방안 등이 주로 논의되었다.
이 행사에는 함상욱 다자외교조정관의 축사 및 백진현 ITLOS 재판관(전 ITLOS 소장)의 기조연설과 함께 △토마스 하이다(Tomas Heidar)ITLOS 부소장, △마르키얀 쿨릭(Markiyan Kulyk) 외 2인의 ITLOS 재판관, △페마라주 라오(Pemmaraju S. Rao) 전 국제사법재판소 임시재판관, △닐뤼퍼 오랄(Nilüfer Oral) 싱가포르대 국제법연구소 소장 등이 패널로 참석하였다.
The Ministry of Foreign Affairs will be holding the Fifth International Conference on the Law of the Sea from December 3 to 4. The International Conference on the Law of the Sea has been held since 2016 to discuss the latest trends and progress in the research on the United Nations Convention on the Law of the Sea (UNCLOS), which regulates the peaceful usage of the sea and fair and effective utilization of its resources, and on the jurisprudence of relevant international organizations.
The pollution of the marine environment caused by marine litters, microbeads, radioactive water releases, and other sources has become a serious problem. To address marine pollution, we need to employ a global-scale approach and carry out practical actions and measures that take into account the distinct characteristics of each region. Part XII of UNCLOS, often referred to as the Ocean Charter, requires member states to establish and implement innovative and comprehensive legal mechanisms to protect and preserve the marine environment. Section 2 of Part XII, in particular, stipulates that all member states need to cooperate on a regional basis for the protection and preservation of the marine environment. It also obliges member states to notify imminent or actual damage by pollution on the marine environment, develop and promote contingency plans against pollution, and actively participate in exchanges of information and data.
This year’s International Conference on the Law of the Sea will bring together experts from home and abroad, and they will share their experiences and the progress made in their research under the theme of "Regional Cooperation and Marine Environment Protection under UNCLOS”. The conference will serve as a venue for the participants to tap into their collective wisdom to explore ways to effectively apply UNCLOS articles on regional cooperation and protection of the marine environment.
On the first day of the conference, there will be presentations and debates about the cooperation obligations stipulated in UNCLOS and regional cooperation for marine environment protection. On the second day, participants will have in-depth discussions on marine scientific research cooperation in overlapping waters, regulation and prevention of marine pollution, and peaceful resolution of marine environment disputes.
This year, Jin-Hyun Paik, judge of the International Tribunal for the Law of the Sea (ITLOS), will give the keynote speech and Vice-President of ITLOS Tomas Heidar will participate as a presenter. Other ITLOS judges including Markiyan Kulyk, Oscar Cabello Sarubbi, and Neeru Chadha will also participate as presenters and debaters. Renowned international law scholars and practitioners in and out of the country will also take part in the discussions to seek ways to encourage regional cooperation in protecting the sea and its resources.
